Copyright & DMCA Policy

Eriks Art Studio LLC ("the Studio," "we," "us," or "our") respects the intellectual property rights of creators and expects visitors, clients, and partners to do the same. This policy explains ownership of content on www.eriksartstudio.com and the procedure for reporting alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512.


1. Ownership of Content


All artworks, images, photographs, videos, text, essays, designs, logos, and other materials on the Site (the "Content") are owned by Eriks Art Studio LLC or by Erik Kling as author and are protected by copyright, trademark, and other intellectual property laws.

  • Purchasing an original artwork or commissioning a work transfers ownership of the physical object only. It does not transfer copyright or grant any right to reproduce, publish, license, or commercially exploit the image of the work.

  • Collectors may photograph a work they own for personal, non-commercial purposes and may lend or exhibit the physical work. Any reproduction for publication, merchandise, advertising, or sale requires the Studio's prior written permission.

  • Content may be viewed on the Site for personal, non-commercial, educational, or editorial reference. Any other reproduction, distribution, modification, public display, or commercial use without prior written authorization is prohibited.

  • Content may not be used to train, fine-tune, or improve artificial-intelligence or machine-learning systems without the Studio's prior written permission.

 

2. Attribution


Where the Studio grants permission to reproduce an image, the credit line is: "Erik Kling, [Title], [Year]. © Eriks Art Studio LLC. Courtesy of the artist." unless otherwise agreed in writing.


3. Reporting Copyright Infringement (DMCA Notice)


If you are a copyright owner, or authorized to act for one, and believe that content on this Site infringes your rights, send a notice to our Designated Copyright Agent below containing:

  • Identification of the copyrighted work you claim is infringed.

  • Identification of the allegedly infringing material, including its URL on the Site.

  • Your full name, mailing address, telephone number, and email address.

  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.

  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

  • Your physical or electronic signature.

On receipt of a valid notice we will act promptly, which may include removing or disabling access to the material and notifying the person who posted it.

 

4. Counter-Notification


If material you posted was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the Designated Copyright Agent containing: identification of the removed material and its prior location; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, address, and telephone number; consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for any judicial district in which the Studio may be found) and agreement to accept service from the person who filed the original notice; and your signature. We may restore the material in 10 to 14 business days unless the original claimant notifies us that it has filed a court action.


5. Misrepresentation


Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please evaluate a claim carefully before sending a notice.


6. Repeat Infringers


We may remove content and terminate access for users who repeatedly infringe, or are repeatedly alleged to infringe, intellectual property rights.

The Site links to external platforms. We are not responsible for their content or practices. If your work appears on a third-party platform, contact that platform directly.


9. Reservation of Rights
Nothing in this policy limits any legal right or remedy available to Eriks Art Studio LLC or Erik Kling.
