Terms of Service

These Terms of Service ("Terms") govern access to and use of www.eriksartstudio.com (the "Site") and purchases made through it. The Site is operated by Eriks Art Studio LLC, a Florida limited liability company ("the Studio," "we," "us," or "our"). By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.

1. About the Site

The Site presents the artistic practice of Erik Kling, offers original artworks and commissions for sale, and publishes essays and exhibition information. Content is provided for information and cultural engagement and is not legal, investment, tax, insurance, authentication, valuation, or other professional advice.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By placing an order you represent that you meet this requirement and that the information you provide is accurate.

3. Artworks, Prices, and Payment

 

• All works are subject to availability. Each original is unique; once sold it is no longer available.

• Prices are stated in U.S. dollars and may change without notice, except for orders already accepted.

• Payment methods are those offered at checkout and are processed by third-party payment providers. Do not send payment-card details by email or through a website form.

• Applicable sales tax is charged on U.S. orders. International buyers are responsible for import duties, VAT, and customs fees in the destination country.

• An order confirmation acknowledges receipt of your order; a contract of sale is formed when we confirm dispatch or, for commissions, when the commission agreement is signed. We may decline or cancel an order for pricing errors, suspected fraud, unavailability, or shipping restrictions, and will refund any amount paid.
   

4. Commissions

Commissioned works are governed by a separate written commission agreement covering subject, dimensions, materials, timeline, deposit, and delivery. Where these Terms and a signed commission agreement conflict, the commission agreement controls. Commissions are final sale once the creative process has begun.

5. Shipping, Title, and Risk of Loss

We ship worldwide using established carriers and fine-art logistics partners. Title to the work and risk of loss pass to the buyer when the work is handed to the carrier. Every shipment is insured by the Studio for the purchase price, and the Studio manages any transit claim under the Damage Policy on the Orders & Returns page.

6. Returns and Cancellations

Return, cancellation, and damage terms are set out on the Orders & Returns page, which forms part of these Terms. In summary: 14 days from delivery for original works, with conditions; commissions are final sale.

7. Artwork Images and Descriptions

Photographs, room views, and screen colors are illustrative and may not reproduce the exact scale, color, texture, or surface of a work. Dimensions, materials, and descriptions are given in good faith. If a work has been materially misrepresented you may return it under the Orders & Returns page.

 

8. Intellectual Property

All artworks, images, text, video, designs, and other content on the Site are owned by Eriks Art Studio LLC or Erik Kling and are protected by copyright, trademark, and other laws. Purchasing an original artwork transfers ownership of the physical object only; it does not transfer copyright or any right to reproduce, publish, or commercially exploit the image of the work unless a signed agreement expressly says so. 9. Permitted Use of the Site

You may view the Site and share ordinary page links for personal, non-commercial, educational, or editorial reference. You may not reproduce, modify, scrape, distribute, sell, or create derivative works from Site content without prior written permission.

10. Automated Systems and Artificial Intelligence

You may not use artwork images, text, or other Site content to train, fine-tune, evaluate, or improve an artificial-intelligence or machine-learning system without the Studio's prior written permission. Ordinary indexing by general-purpose search engines is permitted subject to the Site's technical instructions.

11. Acceptable Use

You agree not to use the Site for any unlawful purpose; to infringe the rights of others; to interfere with the Site's operation or security; to introduce malicious code; to misrepresent your identity; or to place fraudulent orders.

12. Third-Party Platforms

The Site links to third-party platforms, including social networks and art marketplaces. The Studio does not control their content, availability, or practices. A link is not an endorsement.

13. Disclaimer of Warranties

The Site and its content are provided on an "as available" basis. To the fullest extent permitted by law, the Studio disclaims warranties regarding uninterrupted access, error-free operation, and the suitability of any work for a particular space or purpose. This does not affect the express commitments made on the Orders & Returns page or in a signed commission agreement.

14. Limitation of Liability

To the fullest extent permitted by law, Eriks Art Studio LLC and its members, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or opportunity, arising from use of or inability to use the Site. Our total liability in connection with any purchase is limited to the purchase price paid for that work. Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights in your country of residence.

15. Indemnification

You agree to indemnify and hold harmless Eriks Art Studio LLC and its members, personnel, and representatives from claims, losses, or expenses arising from your breach of these Terms or misuse of the Site.

16. Privacy

Use of personal information is governed by our Privacy Policy, which includes our Cookie Policy.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. To the extent permitted by law, disputes will be brought in the state or federal courts located in Broward County, Florida. Mandatory consumer-protection rules and jurisdiction rights that apply in your country of residence remain unaffected.

18. Changes

We may update these Terms. Revised Terms apply from the effective date shown on this page. Orders already accepted are governed by the Terms in force when the order was accepted.
